In the upper right corner of this picture is a water treatment facility owned by the City of Henderson. There is also an indication of where 500 feet from the water treatment facility falls, reaching almost to the easternmost edge of the park.
Why is this important?
Nevada Revised Statutes NRS 493.109 makes it a misdemeanor to operate within 500 feet of "... a wastewater treatment facility, a water treatment facility ...", "without the written consent of the owner of the critical facility".
Note: It does not say without notifying the owner; it says without the written consent of the owner. If you fly here, have that written consent (letter or email) available for law enforcement.
The good news is that it is relatively easy to get written consent from the Henderson Utilities Department to fly within 500 feet of a Henderson Water Utility facility. Go here and click on the Drone Waiver Near Critical Infrastructure Form link. You will need to submit your request at least 72 hours in advance and be able to upload your Part 107 certificate, your drone registration, and LAANC airspace approval, if needed.
The bad news is that NV Energy has no such procedure for getting written consent for its critical facilities.
Also, if you are outside of the City of Henderson, the water facilities are owned by Clark County and they also do not have a procedure for getting written consent for its critical facilities.
Checklist to fly here:
You got your approval to take off and land from the Henderson Parks and Recreation.
You got your airspace approval from the FAA (class G airspace)
You got your written consent to fly here from NV Energy
You got your written consent to fly here from Henderson Utility Services (Water Department)
Final note:
Flying without a Part 107 certificate or TRUST certificate, not registering your drone, or flying in controlled airspace (or TFR) without authorization is a civil offense, punishable by a fine. Flying near critical facilities "without the written consent of the owner" is a criminal offense, punishable by a fine or jail time.
